FAIRBANKS, Alaska -- The Alaska Court of Appeals has upheld the conviction of a Fairbanks man who stabbed and choked a woman at a North Pole restaurant.

David Sun Do Hesch is serving a 40-year prison sentence for first-degree assault and kidnapping in an attack on Polly Andrews.

The 35-year-old Hesch met Andrews in July 2005. The night they met, they also picked up Hesch's friend, Turhan Ray, and reportedly used cocaine.

A few days later, Hesch invited Andrews to the closed restaurant where he worked and began stabbing her after accusing her of being an informant. Hesch also choked Andrews with an apron.

Ray declined to testify but Hesch claimed it could have acquitted him. The Court of Appeals ruled it would have "no appreciable effect" on the verdict.
